1. Acceptance of Terms

By accessing or using Bullynx (“the Service”), operated by Antoine Duno, an individual trading as Bullynx (sole proprietorship) (“we”, “us”, “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and Antoine Duno (Bullynx).

2. Service Description

Bullynx is an educational AI-powered research platform for retail investors and active traders. The Service provides chart analysis, market research tools, and an AI assistant for educational purposes only. Bullynx is not a financial adviser, investment adviser, broker-dealer, or financial planner. We do not execute trades, hold assets, or manage portfolios.

3. No Financial Advice: Important Disclaimer

Nothing on this platform constitutes financial advice, investment advice, trading advice, or any other form of professional financial guidance. All AI-generated content, analyses, and outputs are provided solely for educational and informational purposes. You are solely and exclusively responsible for all investment and trading decisions you make. Past performance shown or discussed on this platform is not indicative of future results. Antoine Duno (Bullynx) owes no fiduciary duty to any user.

4. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent that you are 18 or older. The Service is not available to residents of Iran, North Korea, Syria, Cuba, Russia, Belarus, or any jurisdiction subject to comprehensive sanctions by the United States Office of Foreign Assets Control (OFAC). We may block access from these jurisdictions automatically.

5. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account. You must notify us immediately at legal@bullynx.com of any unauthorized use of your account. We reserve the right to terminate accounts that violate these Terms.

6. Subscription and Billing

Subscriptions are billed in advance on a monthly or annual basis. Prices are shown in USD and exclude applicable taxes (VAT, GST, sales tax as required by applicable law). We use Stripe for payment processing and do not store your full card number. By subscribing, you authorize Stripe to charge the payment method you provide for the subscription and any applicable taxes.

Bullynx does not offer a free trial. Pro and Elite subscriptions are charged at checkout for the first billing period and renew automatically, monthly or annually, at the price disclosed at checkout (currently $39 per month or $374 per year for Pro, and $99 per month or $950 per year for Elite) until canceled. New accounts may be offered a welcome discount of 50% on their first payment when checkout is completed within 24 hours of account creation. The welcome discount applies once per customer, is applied automatically by Stripe, and may not be reset by canceling, creating another checkout, or changing plans. Subscriptions started with a trial before this policy took effect continue under the terms disclosed at their checkout.

Eligible new accounts choosing monthly billing receive 50% off the first monthly invoice when checkout is completed within 24 hours of account creation. The discount is applied automatically, may be redeemed once, does not stack with other promotions, and does not apply to later invoices. Monthly subscriptions then renew at $39 per month for Pro or $99 per month for Elite until canceled.

We offer a 14-day money-back guarantee on your first non-zero subscription charge. Contact legal@bullynx.com within 14 days of that charge. After the money-back period, subscriptions are non-refundable except as required by applicable law. You can manage or cancel your subscription from Billing. Canceling stops future renewals and does not retroactively refund a charge, except under this guarantee or where required by law.

7. Access Before Subscription

Bullynx does not offer a free product tier. You may select and locally prepare a chart before creating an account, but no AI analysis is performed or delivered until Stripe confirms an active paid or trialing Pro or Elite subscription. Account creation and onboarding alone do not grant access to product features.

8. Acceptable Use

You may not use the Service to:

• violate any applicable law or regulation;
• transmit malicious code or attempt to gain unauthorized access;
• scrape, harvest, or resell data obtained from the Service;
• impersonate any person or entity;
• circumvent rate limits or usage caps through technical means;
• use the Service for market manipulation, insider trading, or any other securities law violation;
• resell or sublicense access to the Service without our written consent.

9. AI Output Limitations

AI-generated outputs may contain errors, inaccuracies, or outdated information. AI models can “hallucinate”, producing plausible-sounding but incorrect information. Always independently verify any data, analysis, or market information before making any decision. We make no warranty regarding the accuracy, completeness, or timeliness of any AI-generated content.

10. Intellectual Property

The Service, including its software, design, and content (excluding user-submitted content), is owned by Antoine Duno (Bullynx) and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes during your subscription term.

11. User Content

By submitting content to the Service (including chart images and conversation text), you grant us a limited license to process that content solely to provide the Service. We do not claim ownership of your content. See our Privacy Policy for how content is stored and deleted.

12. Disclaimers and Limitation of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Antoine Duno (Bullynx) and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service. Our total liability to you for all claims arising from or related to the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim or (b) USD $100.

14. Indemnification

You agree to indemnify, defend, and hold harmless Antoine Duno (Bullynx) and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

15. Termination

We may suspend or terminate your account at any time for violation of these Terms, with or without notice. You may terminate your account at any time from account settings. Upon termination, your right to use the Service ceases immediately. Paid plan access continues until the end of the billing period already paid for.

16. Changes to Terms

We may update these Terms from time to time. We will provide at least 30 days’ notice of material changes via email or prominent notice on the Service. Your continued use after the effective date of changes constitutes acceptance of the updated Terms.

17. Governing Law and Dispute Resolution

These Terms are governed by French law, without regard to conflict of law principles. Any dispute arising from these Terms shall first be submitted to good-faith negotiation. If unresolved within 30 days, disputes shall be brought before the competent courts of France. If you are a consumer, nothing in these Terms removes the mandatory protections of the law of the country where you live, including your right to use the consumer mediation and the European Online Dispute Resolution platform available to you.
